The balance of the audiovisual and cinematographic industry at the time of large video-on-demand platforms Synthesis The report shall consist of two parts. The first part provides an overview of the rapid and massive success of US video-on-demand platforms in France and Europe. Entering the European market with contractual practices from the Anglo-Saxon world, these platforms have profoundly changed the economic balance of the sector. However, the responsiveness of the French and European authorities in adapting the applicable legal framework has nevertheless provided protection for the authors and producers’ rights, particularly in the face of practices involving full acquisition of intellectual property rights (Part 1).
While large video-on-demand platforms are now integrated into the French system for financing audiovisual and cinematographic creation, they still benefit from certain regulatory asymmetries. The major economic weight of these giants also calls for a dialogue at European level on the issue of cultural sovereignty (Part 2).
